1. Service
HitDaHiway provides travel recommendations, navigation assistance, and a marketplace for ordering and booking from independent merchants. Recommendations are suggestions, not guarantees; always follow road rules and conditions over any in-app suggestion.
2. Driver safety
The service is designed for voice-first use while driving. You are responsible for operating your vehicle safely and for complying with local law regarding device use.
3. Purchases
Orders and bookings are contracts between you and the merchant. Every purchase requires your explicit confirmation; prices, taxes, and fees are shown before you confirm. A booking is confirmed only when the supplier confirms it. Refunds follow the merchant’s stated policy plus applicable law; payment processing is handled by our payment partner — we never store raw card numbers.
4. Accounts
One account per person; you’re responsible for activity under your account. You may export or delete your data at any time.
5. Content
Creator and merchant content must be rights-cleared by its publisher. We may moderate, label, or remove content that violates our policies. Reviews must reflect genuine experiences.
6. Sponsored content
Offers that generate commission for HitDaHiway are always labeled. Merchant payment never overrides relevance or safety in ranking.
7. Disclaimers & liability
Service provided “as is”; to the extent permitted by law our liability is limited to amounts you paid us in the prior 12 months. Nothing limits liability that cannot be limited by law.
8. Changes
We’ll notify you of material changes; continued use after notice is acceptance.
Merchant Agreement
The companion agreement for verified businesses on the platform. Like the terms above, it is a draft under legal review and not yet effective. Commission rates and plan fees are published on the pricing page.
1. Listing
Verified merchants receive a storefront, offer tools, campaign objectives, order/booking management, and analytics. Verification requires proof of business identity; misrepresentation is grounds for removal.
2. Offers
You control every published offer: schedule, radius, redemption caps, per-user limits, minimum purchase, blackout dates, and legal terms. AI-drafted offers are suggestions only — nothing publishes without your explicit review and approval. Honor published offers through their stated window or their platform-mediated withdrawal.
3. Orders
You accept or reject payment-authorized orders promptly. Accepted orders must be fulfilled as described. Repeated rejection or non-fulfillment affects ranking and may lead to suspension.
4. Commission
The platform charges the agreed commission on completed transactions it originates. Statements are itemized per order; disputes within 30 days.
5. Traveler privacy
You receive aggregate analytics only. You must not attempt to identify, re-contact outside the platform, or track individual travelers. Traveler location is never shared with you.
6. Data
Your catalog, offers, and performance data remain yours; you grant us the license needed to operate the service. We do not share your confidential performance data with competitors.
7. Suspension
We may suspend listings for safety, fraud, quality, or legal reasons, with notice and an appeal path. Audit logs record moderation actions.
